She came into this while the house was still in studs, and liked the floor plan. The builder told her that if she made an offer, they would finish the house as soon as they possibly could(gave us a date of December 17th), and would explain to us more about what the house would be, and let us pick things out. She put down a full price offer and paid the earnest money and the whole 9 yards within a few days. We had to fight tooth and nail to get any information about what would be in the house(floor coverings, cabinets, etc). House was finished on January 27th, 40 days late. Upon walkthrough, several things were not completed, and a lot of problems with structural things like bowed walls, bowed window frames, etc were found. Before closing, all of these things were brought up. The realtor told her to make a list and these things would be taken care of.<br />
Fast forward to this afternoon. After talking to the builder finally after trying to get in contact with him since the week after she moved in, he is giving her a lot of excuses and telling her they are very busy and she should send an emailed list and they might get to it. Since she closed on the house, and there was no signed agreement to finish the things she found, we basically have no way to hold him accountable to fix these things.</p>
<p dir="auto">The only leg up we have on him is that the other side is not sold yet. I am willing to do whatever it takes to get this stuff fixed. We have though about putting up a sign in the yard making sure potential buyers know the quality fo work to expect from this builder, making it very dificult to sell the other side of the home. Also, someone told me to make a website and put up flyers directing people to this website to try and raise awareness of this guy.</p>
<p dir="auto">What are your thoughts on this? Is the sign Idea considered slander? Any insight would be entertained.</p>

Builtright bought it from the bank, and finished buiding the house. No structural problems at all, just walls being out of whack, trim finishing sucked dick, that kinda stuff, I will post pics when I get home from work</p>

<p dir="auto">Umm, is the realtor the one fixing the house?? You didn't even get a verbal promise from the builder, the realtor just wanted to get paid, which he doesn't get if the house doesn't sell. You got screwed and you really have no recourse other than to hope the builder will want to save their rep. Good luck, hope it gets straightened out.</p>

Could try the better business bureau, sites like angies list, and the sign idea, just make sure you have the necessary proof to prevent any charges of slander. I'll be meeting with my realtor on Thursday and will ask him about it then to get his opinion on the situation...he's a pretty cool dude and I'm sure he knows a thing or two about how to deal with stuff like this. As Nick said though, she didn't have to close if she was not satisfied with the house at the time of closing.</p>
