I personally wouldnt do anything. I would send him my number and then just tell him no, I wont replace it. I wouldnt respond to anymore of his emails. If you go on his site, jonniemaretti.com you can see his other companies. It claims to be openeing a Mortgage company. So If thats the case I highly doubt this guy is the same guy and is probably using a fake name so its a scam. The guy doesnt use proper grammer, punctuation, or even capatlize his words. The dude is a fake.

First off, I sure as hell wouldn't give him my phone number. You most likely have no idea who you are dealing with. Definitely sounds like a scam to me. At the risk of sounding like an echo, I'd tell him to eat shit.

I would tell him to get bent (or just ignore him). He had plenty of time to inspect the item, any normal person in their right mind would have inspected that sort of item the first day they received it! as for legal action any judge would likely tell him hes a douche for waiting a year and a half!
