Taking a business to small claims court
-
I have a couple hundred bucks to dispute over with my current rental company and I am going to take them to small claims court. Just wondering the best way to go about it. I will not be hiring a lawyer but I do have enough supporting evidence to win my case.
My truck was towed after I was claimed to be parked in front of my garage in the "fire lane" for over an hour(I was stopped there to unload something out of my truck for maybe 3 or 4 minutes.) They called the tow truck but I had my truck parked in a legit parking spot near my garage. So when the tow truck came, they towed it out of a regular parking spot that I was OK to park in... I ended up not having a vehicle for 12 hours and paying 200 dollars to get it out of the impound. If I did not have another vehicle I wouldve been screwed. Looking at my receipt I noticed that the name of the Tow Request was "RES. Manager Jessica"...
Jessica is the chick who owns the cats... the ones I've been complaining about to the rental agency. (http://www.fargostreet.com/forums/showthread.php?t=17951) Now she has my car towed... I was also informed that I am the only person to ever have their car towed from these 6 buildings by management... EVER. Do I have a case? They have no proof I was parked there, but I do have a receipt from the towing company that describes where it was towed from, and the description is of a regular parking spot. -
You will lose. Don't waste your time over $200.

Usually the threat of court is enough to make someone pay up or at least willing to deal...inform her/the company of your intent and see what they have to say.
Stop in and inform them them you are on your way to file the claim at the courthouse but figured you'd give them one last chance to rectify the situation before filing the claim. That way you can show them the paperwork (or whatever is involved) so it doesn't look like an empty threat.

Waste of time and money, it's a "fire lane" not an "unloading zone" as much as it sucks just gonna have to deal with it IMO, there are resident managers on site for a reason, even if she is a bitch. Kinda shitty how they towed out of the parking spot tho

doesn't seem worth it for 200. but good luck.if it goes fairly quickly or the resovle it out of court it would be a very easy way to make 200 dollars back. doesnt seem like much but thats 3 months cable/internet bill.

Go to court house and ask front desk guy which floor you need for small claims. Then go up there and explain your situation and they will help you from there.
If you go to court, make sure your approach is that 'she has been hasseling me for awhile, because I have had problems with her cats....' and 'I never stopped in the fire lane, I was parked in a normal parking spot, then come out and find my truck is gone...I thought it was stolen! Why would I assume it was towed from a legit spot...she is simply harassing me!'
If you go into it with the story you listed above, you just wasted $200 + court fees.
Disclaimer - Lying is wrong, and baby Jesus does not approve.
