I'm sure not much good can come from this thread, that's why it is called an accident. My apologies to family though, this isn't the place for grievance.

Sad to hear of your loss.

But... to keep it even on both sides, the sheriff's claim speed was not a factor. If that is true, you can't yell at the driver. Rather yell at the person who should have been watching the kid closer. Especially near a road where the speed limit is 55 mph.

So the driver wasn't suppose to pay attention to what was in the road? I don't know exactly how the accident happen but it seems like both parties can partial be blamed for what happened.

I tend to agree. Speed wasn't a factor, that is true, he was probably only going 55mph, but if he didn't slow down at all it doesn't mean that driver error wasn't a factor. I don't know the whole story, but I do know Starke, so at this point his story is the closest I can get to being straight from the source.

I'm sorry to hear about this man, I can't imagine what the family is going through. They will be in my prayers this evening.

I agree, however he was following the rules of the road. Maybe the sun was in his face and he couldn't see the small child to react fast enough?

We don't know the whole story.. so I probably shouldn't point fingers like I did.. But I do think it's a safe bet to say that it was poor parenting.

Chuck - Would you let your little man wonder around near a highway? I am guessing probably not.

My little guy generally stays on our driveway at home, but there have been times when he's darted onto the road and there is no way I could react fast enough to stop him. Generally speaking, I think people drive way too fast in residential neighborhoods (every day there are at least 2 people who zip through my street at 40 mph...they don't live in the neighborhood, they just get lost and figure the best way to find their way out is to speed....if I'm mowing when they are doing this I am my lawnmower outlet towards them hoping to fling a rock at them)

If the sun was in his eyes he was driving too fast for road conditions. 55mph is the MAXIMUM you can assume the road to be safe for in perfect conditions.

Again, I'm not saying the parents shouldn't have watched a little closer (trust me, I'm sure they are blaming themselves plenty right now) but its not like 2 year olds move at the speed of a deer (or dog) to where they can just dart out in front of you.

I am sorry for your families loss. That sucks beyond belief. I'm sorry for the driver that hit him as well. It may be hard to see from the families point of view right now, but I don't know how I'd be able to cope with killing a toddler. This is a no win situation from any perspective and I feel horrible for all involved. You are all in my prayers.

Thanks guys. It really means a lot.

I won't get into details, partly because from what I heard and out of respect. I almost didn't want to make the thread but I wanted to tell people to please be careful when driving down residential roads. A parent can tell a child something 'til they are blue in the face and the child will (sometimes) still not listen. I don't know how else to say it. Message boards can only say so much.

I think a lot of people that live "Out in the country" Tend not to worry about things like this happening... Although the law contitues 50 percent fault on the driver no matter what, I would say that the family can't point fingers. its a fricken 55mph highway.... maybe you shouldnt live there...
